Terms of Service

Agent Content is a managed content service for licensed real estate agents, teams, and brokerages. Excel Web Interactive researches topics, records and conducts expert interviews, writes and edits articles, prepares original visuals, and supports publication and distribution. It is a guided service operated by our team, not a self-serve software product, and the website does not offer checkout or self-service signup.

The specific scope, deliverables, schedule, territory, and commercial terms of any engagement are set out in the service agreement you sign with Excel Web Interactive. Where that agreement and these terms differ about client work, the service agreement controls.

All clients that have contracted with Excel Web Interactive for the Agent Content platform agree to communication with us by text message, email, and voice call. These channels are used for the ordinary running of the engagement, including scheduling and confirming interviews, gathering topics and feedback, reviewing drafts, sending reminders and service updates, and handling billing or account matters.

Message and data rates may apply, and the cost is charged by your carrier or provider. For text messages, reply STOP to opt out of further texts and reply HELP for help; opt out of texts does not stop email or voice contact that is necessary to deliver the service. For email, you can use the unsubscribe link in a message. You can also ask us to change how we reach you by writing to support@agentcontent.com. Consent to these channels is not a condition of any purchase, and we will work with you on alternatives where practical.

Agent Content runs an SMS program for real estate experts who opt in to be interviewed. Participants receive recurring, non-promotional texts: interview invitations, scheduling links and updates, and reminders. Enrollment requires checking an unchecked consent box; consent is voluntary and is not required to purchase services.

Message frequency varies. Message and data rates may apply. Reply HELP for assistance or STOP to opt out at any time. Carriers are not liable for delayed or undelivered messages. Details and the exact opt-in disclosure are on our SMS Program page.

The services are for businesses and professionals in the real estate industry. You must be legally able to enter into a contract, and where your work requires a real estate licence or brokerage approval, you must hold it and keep it current.

You agree to:

• Give us accurate, current information and tell us promptly when something changes.
• Only send us material you have the right to use, including photos, data, and client information.
• Keep your own claims, credentials, and advertising compliant with applicable law, MLS rules, and broker or association requirements.
• Review content you approve for publication, since you remain responsible for statements made about your business.
• Not include sensitive financial information or confidential client documents in website forms.

You keep ownership of the materials you give us. You grant Excel Web Interactive a licence to use, reproduce, adapt, and publish those materials as needed to provide the service, and you are responsible for having the rights to do so. Please tell us of any restriction on a photo, chart, or document when you send it.

The published offer is a single engagement at $3,000 per month, month to month, with one client per metro territory. Fees, invoicing, payment method, and the territory covered are set out in your service agreement. You are responsible for any sales, use, or similar taxes that apply to your purchase, other than taxes on our own income.

We work with one client in each metro territory so that your content is not competing with another client's in the same market. Territory exclusivity does not mean we will refuse work for clients in other markets, and it is not a promise that no other business operates in or writes about your area.

Ownership of published articles and visuals, and your right to keep and reuse them, is set out in your service agreement. Excel Web Interactive keeps ownership of its methods, research processes, templates, software, platform, and the Agent Content name, logo, and branding, whether or not they were used to produce your content.

You agree not to:

• Copy, scrape, or systematically download website content without our written permission.
• Attempt to access the internal client platform, administrative areas, or another user's data without authorisation.
• Interfere with the website, disable its protections, or submit false or automated content.
• Use our name, branding, or example content in a way that suggests endorsement you do not have.
• Use the website for any unlawful purpose or in a way that infringes someone else's rights.

We do not promise particular search rankings, traffic volumes, backlinks, mentions or recommendations by artificial intelligence systems, leads, or listings. Search engines, publishers, and AI platforms are independent and decide for themselves what to show. Nothing in these terms or on the website is a promise of a specific outcome, and results depend on many factors outside our control.

The example articles on this website are demonstration content for a fictional real estate group. They use invented agents, transactions, and customer experiences, and are not testimonials, reviews, or results from real clients. Nothing on the website is legal, tax, investment, or real estate advice; consult a qualified professional about your own situation.

The website and the services rely on third-party providers for hosting, email, fonts, analytics-free security, and similar functions. Their own terms and privacy policies apply to the parts they provide. We are not responsible for third-party websites or services we link to.

Information you share with us is handled as described in our Privacy Policy. Please do not send confidential client documents through the public contact form.

Client engagements run month to month. Either party may end the engagement as set out in the service agreement. If an engagement ends, we stop new work, you may keep what you are entitled to under the agreement, and any amounts that have accrued remain payable. Sections on ownership, confidentiality, disclaimers, liability, indemnity, and these general provisions continue after termination.

The website and the platform are provided "as is" and "as available" to the extent allowed by law. We do not warrant that they will be uninterrupted, error-free, or free of harmful components, and we do not adopt or endorse content published by third parties. Where a party cannot exclude implied warranties by law, our liability for breach is limited as described below.

To the extent allowed by law, Excel Web Interactive is not liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for lost profits, revenue, listings, or data, even if we were told they might happen. Our total liability arising from your use of the website is limited to the amount you have paid us, if any, and liability arising from a client engagement is limited as set out in the service agreement. Nothing here limits liability that cannot lawfully be limited.

If you give us material you do not have the right to use, or you breach these terms or the service agreement, you will hold Excel Web Interactive harmless from claims, losses, and reasonable costs that arise from that, including legal fees, to the extent allowed by law.

We may update these terms as the website, platform, or our services change. The date at the top of this page shows when it last changed. For clients, we will notify you of material changes by email or text as part of ordinary service communications. Continued use of the website or services after a change takes effect means you accept the updated terms.

These terms, together with your service agreement and the Privacy Policy, are the complete arrangement between you and Excel Web Interactive about the website and the services, and replace earlier statements about them. We may assign our rights and obligations; you may not transfer your agreement without our written consent. If a court finds a provision unenforceable, the rest still stands. If we do not enforce a provision, that is not a waiver of it. Notices to us may be sent to support@agentcontent.com; notices to you may be sent by email, text, or voice call to the details you gave us.

The governing law, venue, and any dispute-resolution steps for a client engagement are set out in that client's service agreement. For everyone else, claims arising from these terms must be brought in the courts located where Excel Web Interactive maintains its principal place of business, and you consent to jurisdiction there.
